This Policy for the prevention of fraud and illegal use of mobile services in the mobile network of "Vivacom Bulgaria" EAD (Vivacom) in the provision of data transmission and Internet access services (the Policy) applies to specific end users in cases of established use of the services contrary to the General Terms and Conditions for the use of mobile services, the conditions of the specific tariff plan and the needs it was created to serve. The policy is an integral part of the contracts for the provision of mobile data transmission and Internet access services.
Use of terminal devices not intended for the specific tariff plan
Vivacom offers as part of its tariff plans for the use of mobile services voice, SMS and Internet access in various combinations between them. The correct use of Vivacom mobile services includes the use of devices such as telephones, smart phones, tablets, laptops, watches and other mobile devices that ensure the use of all elements of the service in its entirety. Unless expressly agreed otherwise, the Mobile Service is not intended to be used as a permanent substitute for fixed Internet access. This includes use in a stationary router or other stationary device.
In case of incorrect use of the service, Vivacom may terminate, limit or take measures to ensure the correct use of the provided services. More specifically, in order to prevent fraud and/or fraudulent use of the data transmission and mobile Internet access services, upon reaching a daily consumption of 10 GB, Vivacom may limit the speed of the specific end user automatically to 64 Kbps. The maximum speed resumes after sending a free SMS to the number 1237 or automatically between 00:00 and 00:59 the next day.
If measures are taken for a specific end user to ensure the correct use of the provided services, the latter can contact Vivacom to select an appropriate tariff plan for the use of mobile services that meets his needs and expectations for the use of specific end devices.
Using measures to temporarily reduce the priority of a specific end user
Vivacom may reduce the network priority of an end user after atypical behavior in the use of mobile Internet access and data transfer services by a specific end user is detected. The latter is done in order to prevent fraud from the use of hacked end devices or prevent the use of the specific tariff plan not for its intended purpose. In this regard:
1. For end users of tariffs with "High" priority, reductions in coefficients are temporarily applied as follows:• upon reaching 98% of the average monthly consumption of mobile Internet access and data transfer services* for the last three months, the priority will be lowered to factor "Standard";• upon reaching 99.98% of the average monthly consumption of the mobile Internet access and data transfer* services for the last three months, the priority will be lowered to the "Low" factor Reductions in the network priority can be carried out consecutively within one reporting period. The assigned priority for the used tariff plan will be restored at the start of the new reporting period.
2. For end users of tariffs with "Standard" priority, a reduction in the coefficient is temporarily applied as follows:• upon reaching 98% of the average monthly consumption of mobile Internet access and data transfer* services for the last three months, the priority will be removed to coefficient "Low";• upon reaching 99.98% of the average monthly consumption of mobile Internet access and data transfer services* for the last three months, the priority will be reduced to the "Basic" factor. Network priority reductions can be made consecutively within one reporting period. The assigned priority for the used tariff plan will be restored at the start of the new reporting period.
* Change in priority status is done automatically based on locating users with atypical behavior.
3. Tariff plans for the provision of mobile Internet access and data transfer services are categorized under the following priority classes:

** The indicated coefficients are exemplary. Changing the numerical value of the coefficient does not change the prioritization step will keep the above ratio.

In order to achieve the goals of this Policy, Vivacom sets the following priorities for individual tariff plans:

*** Tariff plans with a numerical coefficient specified in the contracts will receive the corresponding prioritization step from this Policy.
